General Terms and Conditions of Use

Version of 30 August 2026. This is a translation for convenience; in case of divergence the German version prevails.

1 Scope and contracting party

These terms govern the use of the website www.haydn-research.com together with all content, data and services made available through it, and all services rendered by FJH Research GmbH, Seitenstettengasse 5/37, 1010 Vienna, FN 682934 s (hereinafter “Haydn Research Vienna”). Diverging or supplementary terms of the user do not form part of the contract unless Haydn Research Vienna expressly agrees to them in writing. The version published at the time of use applies.

2 Subject matter

Haydn Research Vienna operates an institution for musicological research and publishes on this website the results of its work: descriptions of works, lists of works and movements, incipits, data on persons and sources, descriptions of watermarks and scribal hands, and accompanying texts.

Use of the website is free of charge. No contract is concluded for the use of freely accessible content; there is no claim to access, availability or continued existence of any particular content. Services against payment are agreed separately; for those, these terms apply in addition to the individual agreement.

3 Scholarly character of the information

The information published reflects the state of research at the given time. Attributions, datings, counts and assignments are the results of scholarly judgement and may change when new sources or findings appear. In particular, the inclusion of a work in the list of works is not a statement as to its authenticity. Haydn Research Vienna strives for accuracy and completeness but gives no warranty. Anyone relying on an entry should check the stated version and the source given.

4 Rights in the content, licences and reuse

Metadata and authority data are made available under Creative Commons Zero (CC0 1.0) and may be reused without restriction. Digitised images and transcriptions in which Haydn Research Vienna holds the rights are made available under Creative Commons Attribution (CC BY 4.0); attribution shall read “Haydn Research Vienna”, together with the location of the item and the date of access.

For digitised images and reproductions whose rights rest with the holding institutions, only the licence or rights statement shown at the individual object applies. That statement takes precedence over the provisions above. Use beyond the scope granted there requires the consent of the entitled institution.

Texts, design, word mark and figurative mark of this website are protected by copyright, trade mark and competition law and are not covered by the licences above. Their use requires prior written consent.

Systematic automated retrieval is permitted insofar as it does not impair availability and the published interfaces are used. For research purposes please make contact; a data export can usually be supplied more easily and more completely.

5 Citation

Since the catalogue is continuously revised, the version must be stated when citing. The recommended form is: designation of the record, HW number, Haydn Research Vienna, location, date of access.

6 Information and submissions by users

Haydn Research Vienna expressly invites information about manuscripts, early copies, prints and other sources relating to Joseph Haydn. Anyone submitting such information, descriptions, images or files warrants that they hold the necessary rights and grants Haydn Research Vienna the non-exclusive right, unlimited in time and territory, to evaluate the material for research purposes, to include it in the data holdings and to publish it stating its origin.

No remuneration is owed for this. There is no obligation to evaluate, to include or to reply. Anyone who does not wish to be named, or who wishes the location of a find to remain confidential, should say so with the submission; this will be respected. Please refrain from submitting confidential documents belonging to third parties.

7 Obligations of users

The website may not be used in a manner that impairs its operation, circumvents security measures or infringes the rights of third parties. In particular, measures liable to place an excessive load on the infrastructure are prohibited, as is altering, removing or obscuring statements of origin, licence or rights.

8 Availability and changes

There is no claim to uninterrupted availability. Haydn Research Vienna may at any time change, extend or restrict the scope of the content and may discontinue operation. Earlier versions of the data are kept accessible so far as possible; long-term preservation is provided through permanently operated institutions.

These terms may be amended where a change in the law, in case law or in the service so requires. The version in force is published on this website with its date.

9 Links to external websites

This website contains links to websites of third parties. Haydn Research Vienna has no influence on their content and does not adopt it as its own. Responsibility rests solely with the respective provider. Upon becoming aware of an infringement, the links concerned will be removed.

10 Liability

Haydn Research Vienna is liable without limitation for intent and gross negligence and for damage arising from injury to life, body or health. For slight negligence, liability arises only upon breach of a material contractual obligation and is limited to the foreseeable damage typical of such contracts.

Liability for loss of profit, indirect and consequential damage is excluded in cases of slight negligence. No liability is accepted for slight negligence in respect of damage arising from the use of the published research data; the data are provided free of charge and without any assurance of fitness for a particular purpose. Claims under the Product Liability Act and mandatory consumer rights remain unaffected.

11 Data protection

Personal data are processed in accordance with the General Data Protection Regulation and the Austrian Data Protection Act. Details are set out in the privacy notice of this website.

Note on research: the catalogue records persons of the eighteenth and early nineteenth centuries. Information relating to living persons is published only insofar as it concerns professional activity in connection with the project.

12 Governing law and place of jurisdiction

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for disputes with entrepreneurs is the court having subject-matter jurisdiction for Vienna Inner City. In relation to consumers this applies only insofar as no mandatory protective provisions of the state of their habitual residence are thereby restricted.

13 Final provisions

Should any provision be or become invalid, the validity of the remaining provisions shall not be affected; the statutory rule shall take its place. Amendments and supplements require the written form, as does any waiver of this requirement.
